Description

The Concluding Report contains the results of the Bilateral Legal Research Group, which was conducted during the period of February to June of 2022 by ELSA Hamburg and ELSA Thessaloniki on the topic of Sexual and Reproductive Rights of Femininities and LGBTQIA+ People.

 

The aim of the report is to shed light on untouched topics of Sexual and Reproductive Health Law, establish the use of the term ‘femininity’ in the legal world and advocate for the enactment of more inclusive legislation regarding the sexual and reproductive rights of all people.

 

Starting with some definitions regarding the terms ‘Sexual and Reproductive Health’, ‘femininity’ and ‘LGBTQIA+’, the report analyses the German and Greek legislation regarding the five most crucial Sexual and Reproductive Rights and makes a comparative approach to other EU and UN legal provisions, describes the social reality of each topic, as well as relevant jurisprudence, and evaluates the effectiveness of the existing legislation, by locating any legislative gaps. The report concludes with recommendations on measures that could be enforced by Germany and Greece in order to ensure the whole enactment and equal enjoyment of all their citizens’ sexual and reproductive rights.
